EU: Dual-Use Regulation – Update of the List of Goods

A license is required for the export of certain goods. Decisive for the licensing requirement are the parameters defined by the legislator in lists of goods. A distinction is made between military equipment and dual-use goods, which can be used for both military and civilian purposes. Now the EU Commission has updated the list of goods.

On January 11, 2023, the European Commission published Delegated Regulation (EU) 2023/66, which contains the updated list of dual-use items (Annex I of Dual-Use Regulation (EU) 2021/821). The updated regulation entered into force on January 12, 2023.

The list of dual-use items is updated regularly to ensure compliance with international obligations.

Background

The original EU dual-use regulation had entered into force on September 9, 2021.
